Process for reporting and resolving cargo damage

Damage Claims Policy

Effective Date: October 26, 2025

1. Scope of Liability

La Casa Logistics LLC coordinates freight dispatch and vehicle transport services. We are not the carrier and do not own or operate vehicles. Liability for cargo damage rests with the actual carrier or transportation provider.

However, we take responsibility for damages caused by our negligence in dispatch coordination or communication errors.

2. Reporting Damage Claims

To file a damage claim, follow these steps:

  1. Immediate Notification: Contact the carrier immediately upon discovery of damage
  2. Document Evidence: Take photos/videos of damaged cargo and packaging
  3. Obtain Carrier Report: Request a damage report from the carrier
  4. Submit to LaCasa: Email all documentation to info@lacasalogistics.com within 48 hours
  5. Include Details: Provide dispatch ID, shipment details, and damage description

3. Claim Investigation Process

  • Claims are reviewed within 5 business days of submission
  • We coordinate with the carrier for their damage assessment
  • We determine liability based on dispatch records and carrier reports
  • Claimant is notified of decision within 10 business days

4. Claim Limitations

The following claims are NOT covered:

  • Damage caused by improper cargo packaging by shipper
  • Damage from natural disasters or acts of God
  • Damage from carrier negligence (carrier's liability)
  • Claims filed more than 30 days after delivery
  • Damage to items not properly declared or insured

5. Maximum Liability

La Casa Logistics LLC's maximum liability for any single claim is limited to the freight value declared at dispatch, not to exceed $50,000 per shipment.

6. Resolution and Compensation

  • Approved claims are compensated within 15 business days
  • Payment is made via the original payment method or check
  • Compensation is based on documented damage assessment
  • Claimant may be required to provide repair quotes or invoices

7. Dispute Resolution

If a claim is denied and the claimant disagrees, they may request a formal review by submitting additional evidence within 14 days of the denial notice.
